These Terms & Conditions (“Terms”) govern your access to and use of tn-tech.us and any related pages, forms, or booking tools operated by Terence Hite d/b/a TN-Tech (“TN-Tech,” “we,” “us,” or “our”).

By accessing or using this website, you agree to these Terms. If you do not agree, please do not use the site.

1. Who We Are

TN-Tech is a sole proprietorship operated by Terence Hite in Louisville, Ohio.

2. This Website Is Informational

The content on this site — including package descriptions, pricing, timelines, examples, and portfolio work — is provided for general informational purposes.

Nothing on this site is a binding offer, a quote, or a guarantee of availability, price, or delivery time. Pricing and package contents may change without notice. Promotional or “founding” rates are limited-availability offers and may be withdrawn or modified at any time.

We work to keep the site accurate and current, but we do not warrant that it is free of errors, omissions, or outdated information.

3. Services Are Governed by a Separate Agreement

These Terms cover your use of the website only.

Any website design, development, hosting, maintenance, or related services we perform for you are governed by a separate written Website Design & Services Agreement and its accompanying Project Order.

If these Terms conflict with a signed Services Agreement, the signed Services Agreement controls.

No project begins, and no obligation to perform services arises, until both parties have signed a Services Agreement and any required deposit has been received.

4. Contact Forms, Quote Requests, and Bookings

When you submit a contact form, quote request, or booking request through this site, you are asking us to get in touch with you. By submitting, you consent to receive replies at the email address or phone number you provide.

Submitting a form does not create a contract, reserve a project slot, or obligate either of us to anything.

Please do not submit sensitive information through our forms — including passwords, account credentials, payment card numbers, Social Security numbers, health information, or anything confidential. If we need credentials to perform work for you, we will arrange a secure method separately.

When you submit a form, we receive a notification by email so we can respond quickly. Your submission passes through and is stored by our third-party email provider under its own terms and privacy policy.

We cannot guarantee that every submission is delivered, or delivered promptly. If a matter is time-sensitive, please call or email directly.

5. Email Communications

We use third-party email infrastructure (currently Resend) to deliver transactional messages such as form confirmations, project updates, invoices, and scheduling notices. Your submitted information passes through and is stored by these providers under their own terms and privacy policies.

Transactional messages relating to an active inquiry or project are not marketing messages. If we send marketing or promotional email, every such message will include an unsubscribe link, and you may opt out at any time without affecting an active project.

6. Acceptable Use

You agree not to:

  • use the site for any unlawful purpose or in violation of these Terms;
  • submit false, misleading, or impersonating information through any form;
  • send automated, bulk, spam, or harvesting requests through our forms;
  • attempt to gain unauthorized access to the site, its servers, or any related systems;
  • probe, scan, or test the vulnerability of the site or circumvent any security measure;
  • introduce malware, or any code intended to disrupt, damage, or overload the site;
  • scrape, copy, or reproduce site content for commercial purposes without written permission;
  • use the site or its content to train a machine-learning or AI model without written permission.

We may restrict or block access to anyone who violates this section, without notice.

7. Our Intellectual Property

The site and its contents — including text, layout, design, graphics, logos, code, and the TN-Tech name and marks — are owned by TN-Tech or its licensors and protected by copyright, trademark, and other laws.

You may view and print pages for your own personal or internal business use. You may not otherwise copy, republish, distribute, modify, or create derivative works from site content without our written permission.

Portfolio work displayed on this site remains subject to the intellectual property terms of the applicable client agreement. Third-party names, logos, and marks appearing on this site belong to their respective owners and are used for identification only.

8. Client Work Shown on This Site

Examples, screenshots, and case studies shown on this site depict work performed for clients. They are illustrative and do not represent a guarantee of comparable results, appearance, timeline, or price for your project.

Client names and websites are shown with permission or in accordance with the portfolio terms of the applicable client agreement. If you are a client and would like your project removed from our portfolio, email us and we will remove it.

9. No Guarantee of Results

We do not guarantee any specific search engine ranking or indexing, amount of website traffic, number of inquiries, conversion rate, volume of sales, revenue, profit, or business growth.

Search optimization and performance work improve a website's technical foundation and usability. Search engines and third-party platforms control their own ranking and indexing decisions, and we do not control them.

10. Third-Party Services and Links

This site relies on third-party providers, currently including:

  • Vercel, website hosting and deployment
  • Resend, transactional email delivery
  • a domain registrar

We may add or change providers as our tools change. We may in the future add scheduling or calendar booking software, and productivity or email services such as Google Workspace. If we do, information you submit may be processed by those providers as well, and we will update these Terms and our Privacy Policy accordingly.

These providers operate under their own terms and privacy policies. We do not control their availability, security, pricing, or practices.

This site may link to third-party websites. We provide those links for convenience and do not endorse, control, or take responsibility for their content, accuracy, or practices.

11. Privacy and Cookies

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

In short: we collect what you submit through our forms, plus standard technical information such as browser type, referring page, and pages visited. We do not sell personal information, and we do not share your phone number or email address with third parties for their own marketing.

Cookies. This site uses only the cookies necessary for it to function. If we later add analytics, advertising, or scheduling tools that set additional cookies, we will update this section and provide any notice or consent mechanism required by law.

You can control cookies through your browser settings. Disabling cookies may affect how parts of the site function.

12. Website Availability

We do not guarantee that this site will be available without interruption, or that it will be free of errors, vulnerabilities, or third-party failures. We may modify, suspend, or discontinue any part of the site at any time without notice.

Nothing on this site constitutes legal, financial, tax, or professional advice.

15. Limitation of Liability

To the maximum extent permitted by applicable law, TN-Tech will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption, arising out of or relating to your use of this website.

To the maximum extent permitted by applicable law, our total aggregate liability arising out of or relating to this website will not exceed one hundred dollars ($100.00), or the amount you have paid us for services in the twelve months preceding the claim, whichever is greater.

If you are a consumer, these limitations apply only to the extent permitted by Ohio law. Nothing in these Terms limits or waives any right or remedy available to you under the Ohio Consumer Sales Practices Act (Ohio Revised Code Chapter 1345) or other applicable consumer-protection law, and nothing here excludes liability for fraud, willful misconduct, or personal injury caused by negligence.

16. Indemnification

You agree to defend, indemnify, and hold TN-Tech harmless from claims, damages, and reasonable expenses arising out of your misuse of this site, your violation of these Terms, or your violation of any law or third-party right — except to the extent caused by our own negligence or unlawful conduct.

17. Changes to These Terms

We may update these Terms from time to time. The current version is always posted on this page with its effective date. Changes apply going forward from the date they are posted. Continued use of the site after an update means you accept the revised Terms.

Changes to these Terms do not modify any signed Services Agreement.

18. Governing Law and Venue

These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles.

Any action arising out of or relating to these Terms or this website will be brought exclusively in the state courts located in Stark County, Ohio, and you consent to the jurisdiction and venue of those courts. Either party may bring a qualifying claim in the small claims division of a court of competent jurisdiction in Stark County, Ohio.

19. Severability and Entire Agreement

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full effect.

These Terms, together with our Privacy Policy, are the entire agreement between you and TN-Tech regarding your use of this website, and are separate from any signed Services Agreement.
